General Terms and Conditions
Article 1 – Definitions
In these terms and conditions, the following definitions apply:
Cooling-off period: the period during which the consumer can exercise their right of withdrawal;
Consumer: a natural person who is not acting in the course of a profession or business and enters into a distance agreement with the entrepreneur;
Day: calendar day;
Duration transaction: a distance agreement relating to a series of products and/or services, where the delivery and/or purchase obligation is spread over time;
Durable data carrier: any tool that enables the consumer or entrepreneur to store information addressed personally to them in a way that allows future consultation and unchanged reproduction of the stored information;
Right of withdrawal: the possibility for the consumer to withdraw from the distance agreement within the cooling-off period;
Entrepreneur: the natural or legal person who offers products and/or services to consumers at a distance;
Distance agreement: an agreement concluded within the framework of a system organized by the entrepreneur for the distance sale of products and/or services, whereby exclusive use is made of one or more techniques for distance communication;
Technique for distance communication: means that can be used to conclude an agreement without the consumer and entrepreneur being physically present in the same place;
General Terms and Conditions: these present General Terms and Conditions of the entrepreneur.
Article 2 – Applicability
These general terms and conditions apply to every offer made by the entrepreneur and to every distance agreement and order concluded between the entrepreneur and the consumer.
Before the distance agreement is concluded, the text of these general terms and conditions will be made available to the consumer. If this is not reasonably possible, it will be indicated before the agreement is concluded that the general terms and conditions can be inspected at the entrepreneur’s premises and will be sent free of charge upon request.
If the agreement is concluded electronically, the terms may be made available electronically in such a way that they can easily be stored on a durable data carrier. If this is not reasonably possible, it will be indicated where they can be accessed electronically and that they will be provided free of charge upon request.
If specific product or service conditions also apply, the above provisions apply accordingly, and in the event of conflicting terms, the consumer may always rely on the provision that is most favorable.
If one or more provisions are invalid or annulled, the agreement and remaining provisions remain in effect, and the invalid provision will be replaced by one that reflects the original intent as closely as possible.
Situations not covered by these terms shall be assessed in the spirit of these terms.
Any ambiguities regarding interpretation shall also be interpreted in the spirit of these terms.
Article 3 – The Offer
If an offer has a limited validity or is subject to conditions, this will be explicitly stated.
The offer is non-binding. The entrepreneur may modify and adjust the offer.
The offer contains a complete and accurate description of the products and/or services. Descriptions are detailed enough for proper assessment by the consumer. Images used are a truthful representation, but obvious mistakes or errors do not bind the entrepreneur.
All images, specifications, and data are indicative and cannot lead to compensation or dissolution of the agreement.
Product images are representative; however, exact color matching cannot be guaranteed.
Each offer includes sufficient information so that the consumer understands their rights and obligations, including:

the price (excluding import duties and VAT, which are the customer’s responsibility)

any shipping costs
-
how the agreement will be concluded
-
whether the right of withdrawal applies
-
payment, delivery, and execution methods
-
acceptance period or price validity
-
communication costs (if applicable)
-
whether the agreement is archived and how it can be accessed
-
how the consumer can check and correct provided data
-
available languages
-
applicable codes of conduct
-
minimum duration for long-term agreements
Optional: available sizes, colors, materials.
Article 4 – The Agreement
The agreement is concluded when the consumer accepts the offer and meets the stated conditions.
If accepted electronically, the entrepreneur will confirm receipt electronically. Until confirmation, the consumer may dissolve the agreement.
The entrepreneur will ensure secure electronic data transmission and a safe online environment.
The entrepreneur may assess whether the consumer can meet payment obligations and may refuse orders or impose conditions if justified.
The following information will be provided:

conditions for withdrawal
-
warranty and after-sales information
-
termination conditions for long-term agreements
All agreements are subject to product availability.
Article 5 – Right of Withdrawal
The consumer may cancel the agreement within 30 days without giving any reason.
The cooling-off period starts the day after receiving the product.
The consumer must handle the product carefully and only use it as necessary for evaluation.
To exercise this right, the consumer must notify the entrepreneur within 30 days and return the product within 30 days thereafter.
Proof of return shipment must be provided.
If not exercised within the timeframe, the purchase becomes final.
Article 6 – Costs in Case of Withdrawal
Return costs are borne by the consumer.
Refunds will be issued within 30 days after withdrawal, provided the product has been returned or proof of return is provided.
Article 7 – Exclusion of Withdrawal
Withdrawal may be excluded for products:

custom-made to consumer specifications
-
clearly personal in nature
-
non-returnable due to nature
-
perishable items
-
subject to financial market fluctuations
-
newspapers and magazines
-
opened audio/video/software
-
opened hygiene products
And services:
-
accommodation, transport, events on specific dates
-
services started with consent before withdrawal period ends
-
betting and lotteries
Article 8 – Pricing
Prices will not increase during the validity period, except for VAT changes.
Variable pricing may apply due to financial market fluctuations.
Price increases within 3 months are only allowed due to legal changes.
After 3 months, increases are allowed if agreed and if:

due to legal changes, or
-
the consumer can terminate the agreement
Import VAT and clearance costs are charged to the customer by courier services.
All prices are subject to typographical errors.

Article 10 – Conformity and Warranty
Products must meet the agreement, specifications, and legal requirements.
Warranty does not affect legal consumer rights.
Defects must be reported within 30 days.
Warranty does not apply if:

products are altered or repaired
-
misused or improperly handled
-
damage results from government regulations
Article 11 – Delivery and Execution
Orders are processed with care and delivered to the provided address.
Delivery occurs within 30 days unless agreed otherwise.
If delays occur, the consumer may cancel and receive a refund.
If delivery is impossible, a replacement may be offered.
Risk transfers upon delivery.
Article 12 – Duration Transactions
Consumers may cancel ongoing agreements with max 1-month notice.
Fixed-term agreements may be canceled at the end of the term.
Automatic renewals are restricted.
Article 13 – Payment
Payments must be made within 7 working days.
Consumers must report incorrect payment details immediately.
Article 14 – Complaints Procedure
Complaints must be submitted within 7 days.
Responses are provided within 30 days.
If unresolved, disputes may arise.
Article 15 – Disputes
Dutch law applies to all agreements.
Article 16 – CESOP
Due to EU regulations, payment providers may register transaction data in the European CESOP system.
